Release of Liability, Waiver of Claims, Assumption of Risks, and Indemnity Agreement.

 

Welcome to Smith Farm Goat Sanctuary. We are committed to providing a safe and enjoyable environment, but due to the nature of our activities, it is important that every participant understands and accepts the potential risks involved. By signing this waiver, you voluntarily agree to the terms and conditions outlined below.

 

1. Acknowledgement of Risks.

 

I acknowledge and understand that my participation at Smith Farm Goat Sanctuary involves inherent risks, including but not limited to:

          • Injuries from animal interactions, including bites, scratches, headbutts, or other incidents involving goats or                       other animals.

          • Trip hazards from uneven ground, tree roots, rocks, or unstable surfaces across the farm property.

          • Potential injury from fences or enclosures, including metal wire or other sharp materials.

          • Weather-related hazards, such as extreme heat, cold, or rain causing slippery conditions.

          • Allergic reactions to animals, hay, plants, or insects.

          • Other unforeseen risks associated with being on a farm with direct animal contact.

 

2. Assumption of Risk.

 

I am voluntarily participating in activities at Smith Farm Goat Sanctuary with the knowledge of the potential risks involved. I accept full responsibility for any harm, injury, or loss I may suffer as a result of my participation, including any personal injury, illness, property damage, or death, whether caused by negligence or otherwise.

 

3. Release and Waiver of Liability.

 

In consideration of being allowed to participate in any activities at the Smith Farm Goat Sanctuary, I, on behalf of myself, my heirs, assigns, personal representatives, and next of kin, hereby release, waive, discharge, and agree not to sue Smith Farm Goat Sanctuary, its owners, employees, volunteers, agents, and affiliates (collectively referred to as the "Releasees") from any and all claims, actions, damages, liabilities, and expenses (including attorney fees) arising from or related to my participation in any activities at the sanctuary, whether arising from the negligence of the Releasees or otherwise.

 

4. Agreement to Abide by Safety Rules.

 

I agree to follow all safety guidelines and instructions provided by Smith Farm Goat Sanctuary staff and volunteers, including but not limited to:

 

           • Treating animals with respect and care at all times.

           • Staying within designated visitor areas unless authorized by sanctuary staff.

           • Supervising children under my care at all times.

           • Refraining from feeding animals without permission.

           • Following staff instructions regarding safety precautions for fences, enclosures, and uneven ground.

 

I acknowledge that failure to follow these rules may result in being asked to leave the premises without refund or recourse.

 

5. Indemnification.

 

I agree to indemnify and hold harmless the Releasees from any claims, actions, damages, costs, or expenses arising out of my participation in sanctuary activities, including but not limited to any claims made by other participants or third parties due to my conduct while at the sanctuary.

 

6. Medical Treatment and Emergency Authorization.

 

In the event of an injury, accident, or illness, I give permission to Smith Farm Goat Sanctuary to provide or seek appropriate medical treatment, including first aid or emergency medical services, on my behalf. I agree to assume full responsibility for all costs related to such treatment.

 

7. Photo and Media Release.

 

I consent to the use of any photos or videos taken of me during my visit for promotional purposes, including social media, the sanctuary's website, or other marketing materials, without expectation of compensation.

 

8. Governing Law and Severability.

 

This agreement shall be governed by the laws of the State of North Carolina. If any provision of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

 

9. Acknowledgement and Understanding.

 

I HAVE CAREFULLY READ AND FULLY UNDERSTAND THIS WAIVER, RELEASE, AND AGREEMENT. I UNDERSTAND THAT BY SIGNING THIS DOCUMENT, I AM GIVING UP IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE THE RELEASEES FOR THEIR NEGLIGENCE. I SIGN THIS AGREEMENT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT OR PRESSURE. THIS WAIVER SHALL BE GOOD FOR ALL CURRENT AND FUTURE VISITS BY THE SIGNING PARTIES TO THE SMITH FARM GOAT SANCTUARY.
